Information Sheet on Data Processing

Subject: Information pursuant to art. 13 of Legislative Decree 196/2003 and article 13 of EU Regulation no. 2016/679 adopted by Legislative Decree 101/2018

Pursuant to art. 13 of Legislative Decree 196/2003 (hereinafter "Privacy Code") and art. 13 of EU Regulation no. 2016/679 (hereinafter "GDPR 2016/679") implemented by Legislative Decree 101/2018, containing provisions for the protection of individuals and other subjects with regard to the processing of personal data, we wish to inform you that the personal data you provide will be processed in compliance with the aforementioned legislation:

Data Controller
The Data Controller is FRANCONIERI & PARTNERS, represented by the legal representative FRANCONIERI DINO, who can be contacted at the phone number and email address agenziafranconieri@gmail.com.

Purpose of processing
The personal data you provide are necessary for the obligations required by law, in particular yours may be processed for one or more purposes related to the implementation of the following obligations, relating to legislative or contractual requirements:

· General personnel management (company tools such as computers and others);

· Management of working hours and attendance in the company;

· Management of access to company premises;

·                   Management of video surveillance for security inside and outside the building (request extended information notice);

· Health and safety at work;

· Management of information, training, and instruction;

· Activity planning;

· Attendance register;

·                   Internal control services;

· Legal and economic treatment of personnel;

· Mandatory legal obligations in the tax and accounting field;

·                   After-sales assistance;

·                   Litigation management;

·                   Customer management;

·                   Detection of customer satisfaction level;

· Customer billing history.

The processing of data necessary to fulfill such obligations is required for proper management of the relationship and providing such data is mandatory in order to achieve the purposes indicated above. The Data Controller also informs you that failure to provide, or incorrect provision of, any of the required information may result in the Data Controller being unable to ensure the appropriateness of the processing itself.
For the purposes of the aforementioned processing, the Data Controller may become aware of data defined as common or special categories. Your sensitive data being processed are only those strictly relevant to the obligations, tasks, or purposes described above and will be processed in compliance with the provisions contained in the relevant General Authorizations of the Data Protection Authority. Your personal data may also, with your prior consent be used for the following purposes:

·                   To present company services and products on the FRANCONIERI & PARTNERS website or social media, through the sharing of photographic or video material that may depict clients;

·                   To fulfill market research, statistics, and promotional activities, including the sending of advertising and promotional material (subscription to newsletters or blogs).

Providing your data is optional for the above-mentioned purposes, and any refusal to provide such data will not compromise the continuation of the relationship or the appropriateness of the processing itself, except for the inability to best serve the customer. This data is functional to optimizing the administrative and commercial relationship and the possible sending of promotional material. It should be specified that most of the processing carried out is not subject to the obligation to obtain consent pursuant to art. 24 of Legislative Decree 196/2003 and art. 7 of the GDPR.

Processing and storage methods
The processing will be carried out in automated and/or manual form, in compliance with the provisions of art. 32 of the GDPR 2016/679 and Annex B of Legislative Decree 196/2003 (arts. 33-36 of the Code) regarding security measures, by specifically appointed individuals and in compliance with the provisions of art. 29 GDPR 2016/679.

We inform you that, in compliance with the principles of lawfulness, purpose limitation, and data minimization, pursuant to art. 5 GDPR 2016/679, and with your free and explicit consent expressed at the end of this notice, your personal data will be stored for the period necessary to achieve the purposes for which they are collected and processed. Your personal data may be processed in the following ways:

·                   Outsourcing of processing operations or by legal provisions;

· Creation of profiles for internal use, relating to clients, suppliers or consumers;

·                   Processing by means of electronic computers;

·                   Manual processing by means of paper archives.

Each processing is carried out in compliance with the procedures set out in Chapter II of Regulation (EU) 2016/679 and Articles 11, 31 and following of Legislative Decree 196/03.

Scope of communication and dissemination
We also inform you that the data collected will never be disseminated and will not be subject to communication without your explicit consent, except for necessary communications that may involve the transfer of data to public bodies, consultants, or other parties for the fulfillment of legal obligations.

Transfer of personal data
Your data may, with your consent, be transferred to member states of the European Union or to third countries outside the European Union.

Special categories of personal data
Pursuant to Articles 26 and 27 of Legislative Decree 196/2003 and Articles 9 and 10 of EU Regulation no. 2016/679, you may provide FRANCONIERI & PARTNERS with data that qualify as “special categories of personal data,” meaning data that reveal “racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as genetic data, biometric data intended to uniquely identify a natural person, data concerning health or a person’s sex life or sexual orientation.” Such categories of data may only be processed with your free and explicit consent, expressed in writing at the bottom of this information notice. The sensitive data processed are only those strictly relevant to the obligations, duties, or purposes described above and will be processed in compliance with the provisions contained in the relevant General Authorizations of the Data Protection Authority.

Existence of automated decision-making processes, including profiling
FRANCONIERI & PARTNERS does not adopt any automated decision-making process, including profiling, as referred to in Article 22, paragraphs 1 and 4, of EU Regulation no. 679/2016.

Rights of the data subject
At any time, you may exercise, pursuant to art. 7 of Legislative Decree 196/2003 and articles 15 to 22 of EU Regulation no. 2016/679, the right to:

a) request confirmation of the existence or non-existence of your personal data;

b) obtain information about the purposes of the processing, the categories of personal data, the recipients or categories of recipients to whom the personal data have been or will be disclosed and, when possible, the retention period;

c) obtain the rectification and deletion of the data;

d) obtain the restriction of processing;

e) obtain data portability, that is, receive them from a data controller in a structured, commonly used and machine-readable format, and transmit them to another data controller without hindrance;

f) to object to the processing at any time, including in the case of processing for direct marketing purposes;

g) to object to automated decision-making relating to individuals, including profiling.

h) Request from the data controller access to personal data and the rectification or deletion of such data or the restriction of processing concerning them or to object to their processing, in addition to the right to data portability;

i) withdraw consent at any time without affecting the lawfulness of processing based on consent given before withdrawal;

j) lodge a complaint with the Privacy Authority.
